§ 1. General Provisions

  1. These Terms of Service ('Regulations') govern the use of the online educational platform available at ascendacademy.com ('Platform'), operated by Ascend Academy Learning Solutions Inc. ('Service Provider'). These Regulations define the rights and obligations of Users and the Service Provider.
  2. By registering for or using the Platform, the User confirms that they have read, understood, and agree to be bound by these Regulations. If the User does not agree to these terms, they must cease using the Platform immediately.
  3. The Platform is intended for individuals seeking to enhance their personal and professional knowledge and skills. The content provided is for educational and informational purposes only and does not constitute professional advice.
  4. The Service Provider reserves the right to amend these Regulations at any time. Users will be notified of significant changes. Continued use of the Platform after such changes constitutes acceptance of the new Regulations.

§ 2. Definitions

  • Platform – The online educational service operated by the Service Provider at the domain ascendacademy.com.
  • User – Any natural person with full legal capacity who registers an Account and uses the Services provided on the Platform.
  • Account – A personal, password-protected profile created by a User on the Platform to access the Services.
  • Services – The provision of access to digital content, including articles, guides, and other educational materials, via the Platform.
  • Regulations – This document, the Terms of Service, which constitutes the agreement between the User and the Service Provider.

§ 3. Type and Scope of Services Provided

  1. The Service Provider offers access to a library of digital content focused on personal and professional development. Services are provided through a 'freemium' model, with both free (Basic) and paid (Premium) access levels, which may differ in the scope of available content and features.
  2. Registration of a free Account is required to access both Basic and Premium services. The scope of features available under each plan is detailed on the 'Pricing' page of the Platform.
  3. The Service Provider grants the User a non-exclusive, non-transferable license to access and use the content for personal, non-commercial purposes only, in accordance with their subscription plan.
  4. The Service Provider does not guarantee that the use of the Platform will lead to specific professional or personal outcomes. The application of knowledge gained is the sole responsibility of the User.

§ 4. Technical Requirements

  1. To use the Platform, the User must have a device with internet access and a modern web browser (e.g., Chrome, Firefox, Safari, Edge) with JavaScript and cookies enabled.
  2. The Service Provider is not responsible for any malfunctions or incompatibilities of the Platform with the User's hardware or software.
  3. The User is responsible for ensuring the security of their login credentials (email and password) and preventing unauthorized access to their Account.

§ 5. Rights and Obligations of the User

  1. The User agrees to provide accurate and current information during the registration process and to keep this information updated. It is forbidden to create accounts using false information or on behalf of third parties.
  2. The User is obliged to use the Platform in accordance with applicable laws and these Regulations. The User may not use the Platform for any illegal or unauthorized purpose.
  3. All content on the Platform, including text, graphics, logos, and software, is the property of the Service Provider or its licensors and is protected by copyright laws. The User agrees not to copy, reproduce, distribute, or create derivative works from the content without explicit permission.
  4. The User is prohibited from posting any unlawful, offensive, or harmful content on the Platform, should any community features be made available. The Service Provider reserves the right to remove such content and suspend the User's Account.
  5. The User may terminate their agreement with the Service Provider at any time by deleting their Account. Paid subscribers can cancel their subscription according to the terms outlined on the Pricing page.

§ 6. Final Provisions

  1. These Regulations shall be governed by and construed in accordance with the laws of the province of British Columbia and the federal laws of Canada applicable therein.
  2. Any disputes arising from the implementation of these Regulations shall be resolved by the competent courts for the registered office of the Service Provider.
  3. If any provision of these Regulations is found to be invalid or unenforceable, the remaining provisions will continue to be in full force and effect.
